By creating an account or using DietBoard, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services. These Terms apply to all users of the platform, including dietitians, nutritionists, and their authorized team members.

2. Description of Service

DietBoard is a clinical nutrition management platform designed for healthcare professionals. Our services include:

  • Patient record management and progress tracking
  • Nutrition plan creation and customization
  • Appointment scheduling and calendar management
  • Secure document sharing with patients
  • AI-assisted meal planning and recommendations
  • Custom branding for professional presentation

3. Eligibility

DietBoard is intended for use by licensed healthcare professionals, including registered dietitians, nutritionists, and their authorized staff. By using our platform, you represent that you are a qualified healthcare professional or are authorized to act on behalf of one. You must be at least 18 years of age to use our services.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials secure and not share them with unauthorized parties
  • Enable two-factor authentication when handling sensitive patient data
  • Notify us immediately of any unauthorized access to your account
  • Ensure all team members added to your account comply with these Terms

5. Data Protection Responsibilities

DietBoard is designed with safeguards to help healthcare professionals protect patient data. As a healthcare professional, you acknowledge that:

  • You are responsible for ensuring your use of DietBoard complies with all applicable laws and professional standards
  • We process patient data on your behalf and are contractually bound to protect it
  • You will only enter patient data with proper authorization and consent
  • You will use appropriate safeguards when accessing patient information

Upon request, we will provide a data protection agreement outlining our obligations when handling patient data on your behalf.

6. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the platform's operation
  • Upload malicious code or content
  • Use the platform to store or transmit any content that violates third-party rights
  • Resell, sublicense, or redistribute access to the platform

7. Payment & Subscription

DietBoard offers subscription-based pricing. By subscribing, you agree to:

  • Pay all applicable fees for your chosen plan
  • Automatic renewal at the end of each billing period unless cancelled
  • Provide accurate and current payment information

All payments are processed securely through Stripe. Refunds are handled on a case-by-case basis. You may cancel your subscription at any time through your account settings.

8. Intellectual Property

DietBoard and its original content, features, and functionality are owned by DietBoard and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you create using our platform, including nutrition plans and patient notes. You grant us a limited license to store and process your content solely for the purpose of providing our services.

9. Limitation of Liability

DietBoard is a tool to assist healthcare professionals. It does not provide medical advice. You are solely responsible for all clinical decisions and patient care. To the maximum extent permitted by law, DietBoard shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the platform.

10. Termination

We may suspend or terminate your access to DietBoard at any time for violations of these Terms or for any other reason at our discretion. You may terminate your account at any time through your account settings. Upon termination, your data will be retained for the period required by applicable law and our data retention policy before being permanently deleted.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of DietBoard after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of DietBoard shall be resolved through binding arbitration or in a court of competent jurisdiction.
